Klempt™ Privacy Policy

1. Introduction

Klempt ("we," "our," or "us") is operated by Halfmoon Imaging LLC DBA Klempt. This Privacy Policy explains how we collect, use, and protect information when you use the Klempt mobile application and related services (collectively, the "App") on Apple iPhone and Apple Watch.

By using Klempt you agree to this Privacy Policy. If you do not agree, please do not use the App.

2. Information We Collect

Information you provide:

• Email address (if you join our waitlist or contact us)
• Messages and text you type in the Message tab for display on your Watch
• Feedback you submit through the app

Information collected automatically:

• Device type and operating system version
• App usage data (which features you use, frequency of use)
• Crash reports and error logs
• IP address and general location (country/region level only)

Apple Watch and sensor data:

• The App sends color and haptic commands to your paired Apple Watch
• Heart rate and biometric data from Apple Watch is processed locally on your device only — it is never transmitted to our servers
• Accelerometer and motion data used for beat sync features is processed locally and not stored or transmitted

Nearby device data:

• The App uses Apple's MultipeerConnectivity framework to discover and connect with nearby devices running Klempt. Device names of nearby peers may be temporarily visible. No data from nearby devices is stored on our servers.

3. How We Use Your Information

• To operate and improve the Klempt app and its features
• To send you updates about Klempt if you have joined our waitlist (you may unsubscribe at any time)
• To diagnose technical problems and fix bugs
• To understand how features are used so we can improve the product
• To comply with legal obligations

We do not sell your personal information to third parties. We do not use your information for advertising purposes.

4. Microphone Access

The Beat Sync feature uses your device's microphone to detect audio rhythms and synchronize Watch glow patterns to music. Microphone access is used only when you actively enable Beat Sync mode. Audio is processed in real time on your device only — no audio recordings are made, stored, or transmitted to any server.

5. Local Network and Bluetooth

Klempt uses Apple's MultipeerConnectivity framework which requires Local Network permission. This allows the app to discover and connect with other nearby iPhones running Klempt to synchronize Watch experiences. All communication between nearby devices is direct and encrypted. No data passes through our servers for local connections.

6. Children's Privacy

Klempt is not directed at children under 13 years of age. We do not knowingly collect personal information from children under 13. If you believe a child under 13 has provided us with personal information please contact us at [email protected] and we will delete it promptly.

7. Data Sharing

We do not sell, rent, or trade your personal information. We may share information only in these limited circumstances:

• Service providers: We may use third-party services (such as crash reporting and analytics) that process data on our behalf under confidentiality agreements
• Legal requirements: We may disclose information if required by law or to protect the rights, property, or safety of Klempt, our users, or the public
• Business transfers: If Klempt is acquired or merges with another company, your information may be transferred as part of that transaction

8. Data Retention

We retain your information only as long as necessary to provide our services and comply with legal obligations. Waitlist email addresses are retained until you unsubscribe. Crash logs and analytics data are retained for up to 12 months. You may request deletion of your data at any time by contacting [email protected].

9. Security

We implement reasonable technical and organizational measures to protect your information. All data transmission between the app and any servers uses encryption. However no method of transmission over the internet or electronic storage is 100% secure and we cannot guarantee absolute security.

10. Your Rights

Depending on your location you may have the right to:

• Access the personal information we hold about you
• Request correction of inaccurate information
• Request deletion of your information
• Object to or restrict certain processing of your information
• Data portability

11. California Privacy Rights (CCPA)

California residents have additional rights under the California Consumer Privacy Act. We do not sell personal information. California residents may request to know what personal information we have collected, request deletion, and opt out of any sale (though we do not sell data). 12. Apple Health and HealthKit

Klempt does not access Apple HealthKit data. Heart rate information displayed in certain features is obtained directly from Apple Watch through Apple's standard WatchKit APIs and is not shared with any third party or stored on our servers.

13. Changes To This Policy

We may update this Privacy Policy from time to time. We will notify you of significant changes by updating the "Last Updated" date at the top of this page and, where appropriate, through the app. Your continued use of Klempt after changes become effective constitutes your acceptance of the updated policy.
